Health-care Reform and the ACA Impacts Small Business

The United States Supreme Court largely upheld the Affordable Care Act in a 5 to 4 decision.? The bill marks a major victory for the Obama administration and will have a major impact on small business owners that own and operate U.S. based companies.

There are two main ways that the bill will leave its mark.? First, small business owners that currently offer health-care to their workers can reduce their costs by an estimated 5 to 10 percent on average.? There are even tax incentives for companies that offer health-care coverage to their workers.? On the other hand, however, some small business owners that employ closer to 100 workers may choose to not offer coverage to their personnel as the taxes they will pay in penalties are actually cheaper than offering benefits.? The worker then needs to find coverage on their own as stipulated by the individual mandate.

This is an ongoing debate that has governing officials and small business owners weighing their options.

It is hard for companies to balance costs with taking care of their employees.? Statistics gathered from healthreform.gov, a federal government website managed by the U.S. Department of Health and Human Service, indicates 33% of the 13 million uninsured Americans work for firms with less than 100 personnel.? With the dramatic rise in healthcare costs, it has become challenging for Entrepreneurs and small business owners to offer these benefits to their workers.

As the Obama Administration has marked this a pivotal win in an election year, entrepreneurs and small business owners alike will have to make equally tough decisions as members of the Supreme Court made during yesterday?s ruling.? Small business owners must decide whether to offer health-care coverage or pay the taxes which may be less expensive.

Up to this point, there has not been enough done to support small business initiatives with taking care of workers.? For example, the health-care law did not require small business owners of a certain size to offer coverage.? Republicans are calling for an appeal to the law, including Republican Presidential hopeful Mitt Romney, who stated if elected President, his first day in office he will appeal the law.

From 2000 to 2007, the percentage of small businesses offering health-care coverage and related benefits fell from 68% to 59% as indicated by healthreform.gov.? During the same time period, health-care costs rose dramatically.? In fact, most small business owners state the reason they choose not to offer health-care to their workers is due to the rising cost in premiums.

It seems clear that until the rising costs are addressed, the problem cannot be solved; then enters the debate of ?doing the right thing?.? That is, offering your employees coverage and thus increasing your costs, or savings and continuing to reinvest in the company.

Illegal Downloading and the Risks for Aussie Pirates - Studio Legal

In their annual Digital Music Report earlier this year, the International Federation of the Phonographic Industry reported that over one fifth of internet users globally access music illegally online on a monthly basis.

While it seems that a large portion of music and movie lovers now value their entertainment as a ?free? resource, it is important to be aware of the legal rights and risks involved in doing so.

Copyright ? the basics

Most television shows, books and music created in the 20th and 21st centuries will be protected by international copyright laws (unless the director, author or artist died over 70 years ago). There is no requirement of registration, therefore once a film or piece of music is created, for example, it is automatically protected by copyright.

Once a copyright work is in existence, the owner (either the author or the person paying for its production), has a bundle of exclusive rights that only they are permitted to use. These rights include the right to reproduce the work, the right to perform the work in public and the right to communicate the work (i.e. make it available online) amongst a few others.

Essentially, the copyright owner has a monopoly to do as they like with the copyrighted work.

Therefore, simply because it is free does not necessarily mean it is illegal. The owner can choose to allow others to use the copyrighted work for free. However, this is an unusual occurrence (Radiohead, anyone?).

If access to the song or film is not directly from the owners website, or a legitimate service like Myspace or Spotify, most of the music and movies found online for free are likely to be illegal.

This is because the process of transmitting the owner?s copyrighted work online by uploading and then downloading it is performing two of the owner?s exclusive rights without their permission, namely the reproduction right and the communication right. This is a direct infringement of copyright.

What happens if you get caught?

As the law and attitudes on illegal downloads are constantly changing, it is difficult to answer this question with much certainty.

Thankfully, the rise of services such as Spotify, Rdio and iView (ABC?s online streaming service) means that there are an increasing number of legitimate avenues to obtain copyrighted music, television or film cheaply or even for free.

While many Internet Service Providers (ISPs) have a policy to deal with copyright infringement, the implementation of an industry wide code that applies to all ISPs has yet to be agreed upon.

A recent High Court case against iiNet (check out here for more details) has reduced a substantial amount of pressure on ISPs to be responsible for its users illegal downloads. However, ISPs may still pass on notices from copyright owners to users they think have infringed their copyright although they may not be required to. These are called ?Infringement Notices?.

Infringement notices ? should you pay attention?

In short, yes.

There are two main consequences of an Infringement Notice:

1. Your ISP may elect to cancel your internet connection if they continue to receive notices from the copyright owner that you are infringing their copyright (usually you must be notified five times before they do so); and
2. The copyright owner may choose to take you to court to recover damages (However, at this point in time, ISPs are not required to give their clients? contact details and identities to the copyright owner ? this would need to be acquired by court order).

While court cases against individuals for copyright infringement are incredibly rare in Australia given the expenses involved, in cases involving copyright infringement (not online) damages awarded for copyright infringement have ranged anywhere from a few hundred dollars to a few hundred thousand.

Conversely, in the United States individuals have previously been targeted for infringing copyright online and given fines of up to $675,000. Further, New Zealand has recently enacted a ?3 strike policy? whereby ISPs are required to pass on notices to customers that a copyright owner alleges is infringing copyright. Once a third notice is sent, the owner may take the customer to the ?Copyright Tribunal? where the minimum penalty is $275 and maximum $15,000, payable to the copyright owner.

Given that the Internet is worldwide medium, penalties are not restricted to Australian law. It is possible, even if only remotely, that an action could be taken against you by US authorities. Currently, a student from the UK that ran a website linking to other websites were users could watch television shows online, is facing extradition to the US over copyright infringement claims where he faces fine of up to $250,000 or five years in prison per song or movie.

Conclusion

Whilst the odds of being caught are somewhat low (particularly given the recent iiNet case), copyright owners are increasingly joining forces and taking new and innovative steps to catch copyright infringers.

Most likely the next step for copyright owners is to lobby for legislative change. However, many are hoping that the rapid growth of legitimate services such as Rdio and Spotify continue to incite the industry to create new business models and better ways to access copyrighted material legally in the digital age.

Northern California fire 20% contained, continues to threaten homes

The so-called Robbers fire in Northern California has burned 2,250 acres and continues to threaten homes, officials said Sunday.

The Placer County fire was 20% contained by 7 a.m., said Matt Damon, information officer for the California Department of Forestry and Fire Protection.

The fire has been burning since Wednesday northwest of Foresthill and threatened 170 homes, Damon said. Evacuations remained in effect Sunday morning.

A total of 1,952 firefighters remained on the scene, fighting the blaze with helicopters, bulldozers and water tenders.

The Red Cross set up an evacuation center with cots, sleeping bags and other basic necessities for affected residents at the Foresthill High School gym.

The California forestry department also has set up an information line for area residents at (530) 823-4083.

Nikon's D4 is currently the only belle at the XQD ball, and until now, Sony was its only memory suitor. However, Lexar's just arrived with a new line of cards to compete for the D4's affections. The Fremont-based company says it collaborated with Nikon to build the PCI Express-based memory, and that they'll hit the market sometime in the third quarter of 2012 -- with no mention of specs or prices so far. Unfortunately, that means we don't know how Lexar's offerings will stack up against Sony's H-series or S-series cards already on the market. Encourage Communication

Keep the doors of communication open for your child. ?Encourage them constantly to talk to you if they have a problem with a friend or anything else they are dealing with. ?Communication is not always just talking. ?Communication can be more listening and hearing what they really say to you. If you allow your child to be open and speak to you honestly and just listen to them, you will be surprised at how well you begin to communicate?better.
Most of all walk the talk. Be a good role model for your children and show them the way to?communicate?effectively to you and others. ?They will use this tool for the remainder of their lives.

I admire the post and learned from it, but I?d like to differ with Sorens on two points. He suggests that methodological individualism is vulnerable to criticism. ?We can know that firms try to maximize profit even if we do not have a good explanation for why each individual firm tries to maximize profit, or why individuals have chosen so to organize themselves. ? He appeals here to what Bob Nozick called a ?filtering device.? The explanation, I take it, is roughly this: to the extent that firms engage in profit maximization, they will tend to supplant firms that don?t.

But this explanation is entirely consistent with methodological individualism. This doctrine does not require that social outcomes be reducible to the motives of individuals. To the contrary, appeals to ?the results of human action but not of human design? are quite common among Austrian methodological individualists.? In thinking that use of ?filtering devices? in Nozick?s sense, irreducible to the psychological motives of individuals, conflicts with methodological individualism, Sorens has I think wrongly taken over Nozick?s unduly restrictive account of that doctrine, in his essay ?On Austrian Methodology?

Sorens also remarks:? ?However, what I have heard from contemporary Austrian economists such as Peter Leeson is that Mises himself was not opposed to hypothesis testing, even using statistical methods. He was merely opposed to Popper-style falsificationism (i.e., that every element of a theory must be falsifiable), which has in any case been superseded in mainstream philosophy of science. ?

Certainly, Mises did not oppose hypothesis testing in applying economics to historical issues; but in economic theory itself he was very much an apriorist. Mises himself is a much better guide to his views on method than ?contemporary Austrian economists?; and if one consults Mises, whether he was an apriorist is not a difficult question to answer.

ALBUQUERQUE, N.M.--Lobo volleyball student-athletes Hannah Johnson and Elsa Krieg, and assistant coach Lisa Beauchene recently returned from a 13-day excursion to China where they played six matches against three of China's top professional teams. The UNM trio traveled with 24 other players and coaches through the Bring It Promotions/USA Volleyball Global Challenge, a development program organized by BIP and supported by USAV.

The three Lobos landed back in Albuquerque late Thursday night and were back to work in Johnson Gym on Friday coaching at UNM's Advanced Skills Camp. All three admitted they were putting forth extra effort to push through jet lag, but they were eager to share the highlights of their experience--competitive volleyball, incredible sights and a renewed appreciation for home.

The journey began in the United States at the American Sports Complex in Anaheim, Calif., home of the USA National Teams. All who were traveling to China assembled for two days of training before flying overseas. The players were split in to two squads--The All-Star team (USA Blue) and the Development team (USA Red). Both Johnson and Krieg were placed on the All-Star team, and Beauchene served as the assistant coach, working with Kyle Robinson, head coach at Long Island University. The All-Stars were comprised of seven players with professional experience (six of which were All-Americans) and five collegiate players.

Despite the impressive pedigree of the "USA All-Stars," as their Chinese hosts insisted on calling them, the team lost all six of its matches--three in Tianjin ("Tin-gin') and three in Beijing--managing to win just one set. The professional Chinese teams play a very fast and efficient style of play, which all three Lobos agreed was an unexpected discovery.

"It was very challenging, even for the professional players on our team that have played at that level," Beauchene said.

It seemed like the Chinese teams didn't have a weakness--they hit hard, had perfect or at least playable passes and were solid from behind the service line. No top-spin serves--just solid floaters.

"There were only a few that did jump float serves," Krieg, a sophomore, said. "Most of them just stood behind the line and hit it right at you as hard as they could."

Johnson, a redshirt freshman, said the teams they played used quick, trick plays that caught the All-Stars off guard at first, but eventually they were able to adjust to the spastic play.

Both Krieg and Johnson played a fair amount and agreed they got a lot out of the experience volleyball-wise.

Johnson was the setter for the set that the All-Stars won and Krieg excelled at the net--recording as many as six blocks in one set, and at the service line.

The fast-paced play called for heightened focus on the opposing teams' hitters.

"You really have to stay disciplined and you have to watch what is going on instead of trying to guess," Krieg explained. "Lisa B (Beauchene) kept telling me to stay disciplined and balanced."

Learning from the competition was another important part of the volleyball experience.

"For me, watching the setter on the other side [was helpful]," Johnson said. "She had great ball control, she knew who she was going to set. She ran her offense really well and it helped me to think about how I could run my offense with the team in China and how I should run it back here with our hitters at UNM."

Beauchene, too, felt the trip benefited her.

"It was a good experience coaching talented and athletic U.S. players and working through playing against the Chinese offense," Beauchene said.

Off the court, the All-Stars had some opportunities to visit some of China's biggest attractions - The Great Wall, the Forbidden City and Tiananmen Square, to name a few. The group didn't get to tour any of the facilities used for the 2008 Beijing Olympics, but they drove by the Bird's Nest and Olympic Park.

From the comforts of UNM volleyball's team room, the Lobos expressed a renewed appreciation for home.

"It was a culture shock," Krieg said of her time in China.

Johnson agreed and added: "It makes us feel very grateful for what we have here in the States."

The student-athletes described some of the restrictions in China that people in the United States don't really think twice about.

"We have the right to buy a car whenever we want--they have to be in a lottery to get a car and they can only drive their car certain days of the week," Johnson explained. "They have to pay for their housing by the square meter; it's very expensive."

Even something as common as a bathroom was a cultural experience for the American tourists as the commonplace commode was a rarity and finding a real toilet there was a luxury.

Other Lobos on the move this summer...
Chantale Riddle participated in the 2012 U.S. National Women's A2 Program in Columbus, Ohio June 26-July 4. The redshirt sophomore was one among 48 of the nation's top returning collegiate players to participate in the program. The group assembled and spent two full days training before splitting in to teams for a round robin tournament. Riddle's team went 4-1 in match play.

Lobo junior libero Miquella Lovato is currently in Croatia on a Global Challenge tour and will return in roughly a week and a half.

Mutations in autism susceptibility gene increase risk in boys

ScienceDaily (July 12, 2012) ? Researchers at Emory University School of Medicine have identified five rare mutations in a single gene that appear to increase the chances that a boy will develop an autism spectrum disorder (ASD).

Mutations in the AFF2 gene, and other genes like it on the X chromosome, may explain why autism spectrum disorders affect four times as many boys as girls.

The mutations in AFF2 appeared in 2.5 percent (5 out of 202) boys with an ASD. Mutations in X chromosome genes only affect boys, who have one X chromosome. Girls have a second copy of the gene that can compensate.

The results were published July 5 in the journal Human Molecular Genetics.

"Our data suggest that AFF2 could be one of the major X-linked risk factors for ASD's," says senior author Michael Zwick, PhD, assistant professor of human genetics at Emory University School of Medicine.

The finding bolsters a growing consensus among geneticists that rare variants in many different genes contribute significantly to risk for autism spectrum disorders.

The mutations in the AFF2 gene probably do not cause ASDs all by themselves, Zwick says.

"We do not think that the variants we have identified are monogenic causes of autism," he says. "Our data does support the idea that this is an autism susceptibility gene."

In some situations, mutations in a single gene are enough by themselves to lead to a neurodevelopmental disorder with autistic features, such as fragile X syndrome or tuberous sclerosis complex. But these types of mutations are thought to account for a small number of ASD cases.

Recent large-scale genetic studies of autism spectrum disorders have identified several "rare variants" that sharply increase ASD risk. Scientists believe rare variants could explain up to 15 or 20 percent of ASD cases. However, until now no single variant has been found in more than one percent of ASD cases.

Working with Zwick, postdoctoral fellow Kajari Mondal and her colleagues read the sequence of the AFF2 gene in DNA from 202 boys diagnosed with autism spectrum disorders. The patient samples came from the Autism Genetic Resource Exchange and the Simons Simplex Collection.

Tests showed that in four cases, the affected boys had inherited the risk-conferring mutations from their mothers. One boy had a "de novo" (not coming from the parents) mutation. Compared with X-linked genes in unaffected people, mutations in AFF2 were five times more abundant in the boys with ASDs.

The AFF2 gene had already been identified as responsible for a rare inherited form of intellectual disability with autistic features. This effect is seen when the AFF2 gene is deleted or silenced completely.

AFF2 has some similarity to FMR1, the gene responsible for fragile X syndrome. Like FMR1, it can be silenced by a triplet repeat. In these cases, the presence of the triplet repeat (three genetic bases repeated dozens of times) triggers a change in chromosomal structure that prevents the gene from being turned on.

In contrast, the mutations Zwick's team found are more subtle, slightly changing the sequence of the protein AFF2 encodes. Little is known about the precise function of the AFF2 protein. A related gene in fruit flies called lilliputian also appears to regulate the development of neurons.

Zwick says one of his laboratory's projects is to learn more about the function of the AFF2 gene, and to probe how the mutations identified by his team affect the function. His team is also working on gauging the extent to which other genes on the X chromosome contribute to autism risk.

Sharing a meal with a former romantic partner is more likely than other, non-food-related activities to make your current partner jealous, according to a study published July 11 in the open access journal PLoS ONE.

The authors, led by Kevin Kniffin of Cornell University, asked undergraduate students to rate their jealousy in response to hypothetical scenarios involving their romantic partner engaging with a former partner, either by email, phone, coffee, or a meal. They found that a meal elicited the highest jealousy ratings, potentially pointing to the importance of meals for human relationships and intimacy. Interestingly, the researchers did not find any significant differences in the jealousy reported by male versus female participants.

Dr. Kniffin remarks, "Given the tradition and fashion of food sharing among co-workers, family members, and friends, our findings are notably consistent with the idea that eating together has importance beyond nutritional factors. By applying a functional view of jealousy, our studies yield the inference that people think meals can be more than just meals."

Rising Shale Water Complicates Fracking Debate

The nation's boom in natural gas production has come with a cost: The technique used to get much of the gas out of the ground, called hydraulic fracturing, or fracking, has contaminated drinking water. But how often and where this contamination is taking place is a matter of much debate and litigation.

Now, a new study has found natural pathways of contamination ? but that doesn't mean the drilling industry is off the hook.

When gas drillers frack, they pump millions of gallons of water, mixed with sand and chemicals, down into a layer of rock called the Marcellus Shale of Pennsylvania. That helps free up natural gas that then comes to the surface.

But some Pennsylvanians say that polluted water may be seeping back up. They report a salty brine, sometimes laden with dangerous metals, in their water wells. Industry officials say no: The Marcellus layer is over a mile deep ? too deep for water to seep up through all that rock and get into water wells.

Scientists from Duke University have published a paper that says that, in fact, water can rise up from the Marcellus layer.

"What we show in this paper is that there are certain places that it does look like there are connections from the surface to deep underground," says Robert Jackson, an ecologist and chemical engineer. His team studied over 400 groundwater samples. Some were slightly salty, or briny, and some were very briny.

They looked for the chemical fingerprint of brine from the deep Marcellus layer. And they found it in the saltiest samples.

"The water found in those locations looks very salty, like what you see deep underground and contains gases, and just looks like the deeper brine," he says.

There's a catch, though: The briniest water wasn't near operating gas wells. In some cases, the samples were taken before fracking came to the state.

Writing in the journal Proceedings of the National Academy of Sciences, Jackson says that suggests there are some natural conduits that allow deep, briny water to rise to the surface ? from the same shale layer that gas companies are drilling into.

Jackson says he's trying to distinguish what's natural seepage and what may be from fracking. He's also studying how it gets up, too ? through natural fractures in the earth, perhaps, or old oil and gas wells that predate the fracking boom.

"They are a possible conduit for movement of salts or fracking chemicals or even gases up to the surface," Jackson says. "But we just don't know how likely that is."

Complicating The Fracking Debate

The discovery complicates the fracking debate. It suggests that briny water with methane or metals like barium or strontium isn't necessarily from drilling. But it also means that if natural water is coming up from over a mile underground, the drillers' frack water could come up, too.

Jackson says the findings need to be confirmed with more research. David Yoxtheimer, a geologist at Penn State, says in the meantime, it will cause arguments about fracking.

"I think it could certainly fuel that debate: Do we understand the geology well enough to know that, you know, we can do this safely without impacting groundwater?"

Yoxtheimer says the Marcellus layer is pretty dry and spongelike. It can absorb lots of water from fracking without returning it to the surface until it's soaked through ? an unlikely scenario, he says.

And it could take centuries for any kind of water to rise a mile through rock.

Brian Stewart, a geochemist at the University of Pittsburgh, says the Duke research is part of an effort to diagnose what Pennsylvania's water looked like before fracking and after, in a state whose water has experienced over a century of industrial pollution.

"It's a mess when you look at it. When you look at any individual source of pollution it seems almost hopeless, but it's really not," Stewart says. "You need sort of a mixed tool bag, but I think we're starting to get there."

And the research does identify areas with clean groundwater, with little or no natural salt or pollutants, so that if something nasty shows up in that water, it's most likely not natural.

Boys Are Not Immune to Eating Disorders

You may not think boys are at risk either, but the Center for Pediatric Eating Disorders at Children?s Medical Center has seen a dramatic increase in the percentage of boys younger than 18 in its program ? from 11 to 24 percent in just five years. Think wrestling, swimming, cycling, and gymnastics ? sports identified by a specific body type and/or weight. ?Boys are not immune to cultural messages of beauty or fitness and feeling pressures of body type,? says Shari Scott, Ph.D., the center?s clinical director.

Signs of an Eating Disorder

Kids sometimes struggle with eating disorders for some time before anyone notices. Dr. Scott says these may be signs your child is having problems:

  • Intense fear of weight gain or being ?fat?
  • Extreme concern with body weight and shape
  • Extreme rituals or rules around food or eating
  • Refusal to maintain body weight at or above a
    minimally normal weight for height, body type, age,
    and activity level
  • Repeated episodes of bingeingon largeamounts of food
  • Purging after a binge, typically by self-induced vomiting
  • Abuse of laxatives, diet pills, and/or diuretics
  • Excessive exercise or fasting

Don?t Delay if You Detect Signs

Ignoring the warning signs could potentially compromise your child?s health. Anorexia can lead to dehydration and malnutrition, while bulimia increases the risk for heart and esophagus issues. Normal adolescent growth and development are another concern. Girls with eating disorders throughout their adolescence can experience compromised estrogen production and bone density. Production of testosterone and other hormones can be delayed in boys.

The causes of eating disorders are just now being better understood. Cultural pressures, a child?s temperament and style of coping with stress, family dynamics, depression, and anxiety can all play a part. If the signs are present, consider seeing your pediatrician or a mental health provider who specializes in the treatment of eating problems right away. The sooner you seek help, the better the prognosis.
